“A case that stands out in my mind is of a couple who experienced home damage from Hurricane Sally. Hurricane Sally’s wrath left my clients’ home, their sanctuary, riddled with leaks. They reported the claim as the damage was occurring, documented everything religiously, but their insurance company, instead of playing its part, played a cruel game of ‘Delay, Deny, More Delay.’ Then, the insurance company had gone bankrupt, leaving the couple in a financial lurch and Florida Insurance Guarantee Association (FIGA; a nonprofit corporation created by the Florida Legislature in 1970 to handle the claims of insolvent property insurance companies) to pick up the pieces.
“But, picking up the pieces turned into fumbling them over and over. FIGA sent out an engineer whose estimate was riddled with errors. My clients, a sweet older couple, meanwhile, were hemorrhaging money. They’d paid for tarps – three times – to keep the relentless Florida rain at bay. Storage fees for displaced belongings ate into their savings as well. Worst of all, they were living with a house reeking of mold; the damp ceiling a constant reminder of their misfortune. Imagine – a married couple in their late 60s living with moldy, dripping ceilings for nearly four years, all while FIGA kept generating inaccurate estimates and incomplete responses. Some wrongdoings were confessed to, but confessions don’t fix leaky roofs or mend the emotional toll.
“Unfortunately, many times the bureaucratic system, combined with the games insurance companies play to delay claims, prevents cases from going faster than we’d all want. We did everything right throughout the process, but my clients deserved better. They didn’t deserve this financial and emotional nightmare for years on end.
